Perlindungan Hak Anak Akibat Kekerasan Seksual Perpsektif Maqasid Syariah Dan Hukum Positif

Penelitian ini membahas perlindungan hak anak dalam konteks kekerasan seksual yang terjadi di pondok pesantren, dengan menggunakan perspektif Maqasid Syariah yang dikemukakan oleh Yasser Auda, serta mengintegrasikannya dengan hukum positif. Tujuan penelitian untuk menganalisis relevansi konsep-konsep Maqasid Syariah dalam melindungi hak anak yang menjadi korban kekerasan seksual, serta mengkomparasikan terhadap hukum positif. Penelitian ini menggunakan pendekatan fenomenologi dan metode analisis literatur dengan mengacu pada karya-karya Yasser Auda tentang Maqasid Syariah dan studi-studi hukum positif yang berkaitan dengan perlindungan hak anak dan kekerasan seksual di pondok pesantren. Hasil penelitian menunjukkan bahwa Pertama, Latar belakang pelaku yang merupakan pimpinan pondok pesantren hanyalah dikarenakan oleh syahwat dan kemauan secara sadar dengan memaksa pihak korban untuk menikah sirri tanpa sepengetahuan orang lain. Kedua, bentuk perlindungan hukum yang diberikan kepada korban kekerasan seksual diproses secara hukum, memberikan perlindungan kesehatan berupa kesehatan mental melalui UPT Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2A) Kutai Kartanegara, dan menawarkan bantuan hukum kepada pihak korban untuk didampingi. Ketiga, harus mengikut sertakan peran agama, melindungi jiwa korban baik dari fisik maupun non fisik (mental), memberikan jaminan pendidikan yang baik, keturunan yang didapatkan dari pernikahan berdasarkan kesepakatan, perlindungan dalam sosial ekonomi, perlidungan dalam bentuk membersihkan nama baik korban.
