Philosophy and Methodology In Islamic Law: Pendekatan Sistem Terhadap Teori Hukum Islam

Abstrak
Permasalahan-permasalahan hukum islam yang muncul pada masa kini
berbeda dengan persoalan hukum yang terjadi pada masa lampau.
Perbedaaan yang dimaksud bisa berupa perbedaan materi hukum atau
konteks hukumnya. Perbedaaannya bisa disebabkan oleh faktor tempat
yang jauh dari tempat tumbuh dan berkembangnya hukum islam, seperti
permasalahan hukum islam bagi masyarakat minoritas muslim yang
tinggal di negara-negara barat; faktor masa (era) yang terpisah jauh dari
masa (era) dibukukannya fiqh klasik yang banyak menjadi pegangan,
ataupun faktor esensi dan format yang memang baru ada dan tidak
ditemukan padanannya pada masa sebelumnya, seperti cloning, bayi
tabung, e-commerce, dan lain sebagainya.
