Dinamika Sistem Pembagian Warisan Masyarakat Melayu Tuatunu Indah Bangka Belitung Perspektif Fungsionalisme Struktural
Abstract
This study examines the dynamics of the inheritance distribution system in the Malay community of Tuatunu Indah, Bangka Belitung, through the perspective of Talcott Parsons’ structural functionalism. The research focuses on the shift from the customary inheritance system known as Bagi Rusa, which is based on family deliberation and social justice, toward the implementation of Islamic inheritance law (faraidh), which is more structured and provides legal certainty. The objectives of this study are to describe the inheritance distribution practices within the community and to analyze the dynamics of the inheritance system using the framework of structural functionalism. This research employs a qualitative (empirical) method with a sociological approach. Primary data were obtained through in-depth interviews with customary leaders, religious leaders, and local community members, while secondary data were used as supporting sources. The novelty of this research lies in the use of a structural functionalism perspective to analyze the interaction between two different legal systems. The findings reveal that two inheritance distribution patterns coexist in the community: the Bagi Rusa customary system and the faraidh system, which interact within the practice of inheritance distribution. The analysis based on Talcott Parsons’ structural functionalism using the AGIL framework Adaptation, Goal Attainment, Integration, and Latency. shows that this transformation represents a social adaptation to religious and legal demands for clearer rules. Goal attainment is achieved through fair and sharia-compliant inheritance distribution, integration occurs through the accommodation of faraidh principles within local customary practices, and latency functions to maintain social stability and family harmony. This study contributes to a deeper understanding of how customary law and Islamic law operate simultaneously to maintain social balance in a continuously evolving society.
