Abstract

Penelitian ini bertujuan untuk menganalisis kepatuhan syariah terhadap penyelenggaraan donasi abadi pada platform Kitabisa.com, yang mengintegrasikan cash waqaf dengan skema crowdfunding digital. Jenis penelitian yang digunakan adalah yuridis empiris melalui pendekatan kualitatif (lapangan) dengan fokus analisis terhadap kesesuaian pelaksanan donasi abadi dengan UU No. 41 Tahun 2004, PP No. 42 Tahun 2006, PMA No. 14 Tahun 2025 dan Fatwa DSN MUI No. 02/DSN-MUI/IV/2002 Tentang Wakaf Uang. Data primer bersumber dari observasi platform Kitabisa.com dan dokumentasi, sementara data sekunder di peroleh melalui tinjauan literature. Digitalisasi wakaf seringkali dianggap sebagai solusi inklusi, namun penelitian ini mengungkap adanya degradasi prinsip taʾbīd al-aṣl (keabadian harta pokok), terhadap kebijakan pemotongan 5 % dari donasi pokok untuk operasional platform. Serta adanya anomali prosedural yakni belum adanya validasi kecakapan hukum wakif, deskripsi mengenai identitas Nazhir, saksi dalam ikrar wakaf digital, serta ketiadaan AIW dan ketidakjelasan keberadaan peran LKS PWU pada platform Kitabisa.com, sehingga dapat berakibat pada ketiadaan jaminan kepastian dan perlindungan hukum atas harta wakaf kepada wakif. Meski demikian, secara subtansi donasi abadi telah memenuhi rukun dan unsur wakaf sebagaimana diatur dalam regulasi wakaf di Indonesia. Implikasi penelitian menunjukkan urgensi rekonstruksi wakaf yang lebih adaptif  dengan memberikan standarisasi sharia governance terhadap pihak perantara (platform digital) dalam penyelenggarakan wakaf uang.
