Perlindungan Hukum Terhadap Bidder Lelang Online Melalui Instagram Perspektif Maqashid Syariah

Abstract

Pelaksanaan lelang online melalui media sosial Instagram berkembang pesat, namun belum diimbangi dengan perlindungan hukum yang memadai bagi bidder (penawar). Praktik lelang tersebut berpotensi menimbulkan kerugian, seperti penipuan, manipulasi harga, dan ketidakjelasan objek lelang. Penelitian ini bertujuan menganalisis perlindungan hukum terhadap bidder lelang online di Instagram dalam perspektif Maqasid Syariah. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan Maqasid Syariah yang meliputi perlindungan agama (hifz al-din), jiwa (hifz al-nafs), akal (hifz al-‘aql), keturunan (hifz al-nasl), dan harta (hifz al-mal). Hasil penelitian menunjukkan bahwa regulasi positif di Indonesia, seperti Undang-Undang Perlindungan Konsumen dan Undang-Undang Informasi dan Transaksi Elektronik, belum secara spesifik mengatur mekanisme dan tanggung jawab dalam lelang online berbasis media sosial, sehingga bidder rentan dirugikan. Dari perspektif Maqasid Syariah, perlindungan hukum terhadap bidder merupakan perwujudan utama hifz al-mal dan hifz al-nafs. Novelty penelitian ini terletak pada integrasi analisis hukum positif dengan Maqasid Syariah dalam konteks lelang online di Instagram, yang masih jarang dikaji. Penelitian ini berkontribusi memberikan kerangka normatif bagi penguatan regulasi lelang online yang adil, transparan, dan sesuai dengan prinsip Syariah.
