Tinjauan Terhadap Penggelapan Dana dalam Pembiayaan Berbasis Akad: Studi tentang Fenomena Side Streaming

Praktik side streaming dalam pembiayaan syariah menjadi masalah serius dalam industri keuangan, melanggar prinsip syariah dan mengganggu stabilitas sistem finansial. Tujuan penelitian ini yaitu untuk menyelidiki praktik penggelapan dana yang terjadi dalam pembiayaan berbasis akad, dengan fokus khusus pada fenomena side streaming dan untuk memahami mekanisme, motif, dan dampak dari side streaming dalam konteks pembiayaan berbasis akad serta mengeksplorasi upaya pencegahan dan penanggulangan yang dapat dilakukan untuk mengatasi masalah ini. Metode penelitian ini menggunakan pendekatan deskriptif kualitatif untuk menggali motif, proses, dan dampak praktik side streaming. Temuan menunjukkan bahwa side streaming bukan hanya masalah individu, tetapi juga mencerminkan kekurangan pengawasan bank dan tekanan ekonomi pada nasabah. Implikasinya, praktik ini merugikan bank dan masyarakat serta mengurangi kepercayaan pada sistem keuangan syariah. Hasil penelitian ini mendukung pentingnya penegakan prinsip syariah dan langkah-langkah pencegahan yang efektif untuk mengatasi side streaming. Rekomendasi termasuk meningkatkan pengawasan bank, peningkatan pemahaman nasabah, dan penerapan fatwa MUI No. 47/DSN-MUI/II/2005. Dengan demikian, penelitian ini memberikan wawasan holistik tentang fenomena side streaming dan menekankan perlunya perbaikan sistemik dalam industri keuangan syariah.
